GrowthEQ (“we,” “us,” “our”) provides a whitelabeled version of the GoHighLevel platform, operating under the GrowthEQ brand. The Service delivers the full functionality of the GoHighLevel platform, including:
- Customer relationship management (CRM) and contact management
- Lead and opportunity tracking
- Marketing automation and campaign management
- Communication tools, including email, SMS, and messaging
- Calendar and appointment scheduling
- Forms, funnels, and landing pages
- Reporting and analytics
The Service is provided on a subscription basis as further described in your account or order.
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into this agreement. By using the Service, you represent that you meet these requirements.
4. Accounts and Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for all activity under your account.
- You must keep your login credentials confidential and notify us of any suspected unauthorized use.
- We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Send spam, malware, or fraudulent communications.
- Infringe the intellectual property or privacy rights of others.
- Interfere with or disrupt the Service or other users’ access.

- You may not copy, modify, distribute, or reverse-engineer the Service except as expressly permitted.
8. Confidentiality and Data
- We will treat your data as confidential and will not disclose it except as described in our Privacy Policy or required by law.
- You are responsible for ensuring that you have the rights to all data you upload, including contact and customer information.

11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the amounts you paid to us in the [12] months preceding the claim.

These Terms are governed by applicable law. Any disputes shall be resolved through the process described in your agreement or as otherwise required by law.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a revised version and/or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other incorporated documents, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
